TERMS and CONDITIONS

 

 These terms and conditions apply to purchases in the online store kaboceramics - Kateřina Borovcová (www.kaboceramics.com). The business conditions further define and clarify the rights and obligations of the seller and the buyer (customer).

 By sending the order, the buyer confirms that he agrees with the Business Conditions and they will apply to all relations between the seller and the buyer when concluding the purchase contract and any claims for goods.

 

 

Order of goods

 

 All orders created on www.kaboceramics.com are binding on both parties. By sending the order, the buyer confirms that he has read these General Terms and Conditions. The seller will confirm the receipt of the order by sending a confirmation e-mail. The seller reserves the right not to accept an order from a buyer who has not properly received or paid for the goods in the past. The buyer can cancel the order via e-mail within 24 hours of sending the order. The buyer is liable for damages incurred by the seller due to improper use of the online store.

 

The seller reserves the right to cancel the order if

 

  • the contact details are not properly completed by the buyer

  • the required goods is not available for a longer period. The seller will inform the buyer of this fact without undue delay.

 

 

Price of goods

 

 The price of goods is always listed for individual items. All product prices are stated in value including tax. The price for transport will be added according to the chosen method of delivery and according to the weight of the ordered goods.

Delivery time

 

 The seller undertakes to send the goods within 3 working days of receiving payment for the goods on account.

Delivery time within 14 working days from receipt of payment for the goods on account. The buyer undertakes to pay the full amount of the purchase price of the goods, including postage. The buyer acquires ownership rights to the goods until the day of payment of the price in favor of the seller in full. The seller is not responsible for delayed delivery of goods caused by the post, resp. Delivery service. or damage to the goods caused by the post, resp. delivery service. The seller is not responsible for the impossibility of delivery of goods due to force measures or if the ordered goods are not available on the market within the required period. The order can be canceled within 24 hours of receiving the confirmation e-mail.

 

 

Withdrawal from the contract, return of goods

 

 In accordance to the law, the buyer is entitled to return the goods without giving a reason to the seller within 14 days of receipt. It is necessary to withdraw from the contract in a verifiable manner (in writing, by e-mail) stating the order number and the date of purchase.

Later withdrawal from the contract is no longer possible. Subsequently, the buyer sends the goods back to the seller or, by prior arrangement, delivers in person to the address Bořivojova 114, Prague 3, no later than 21 days after delivery of the goods to the buyer. In this case, the buyer is obliged to return the unused and complete goods in the original packaging together with the proof of purchase. The costs associated with the return of goods are borne by the buyer. We recommend sending the goods as an insured shipment. When returning goods, it is not possible to accept the return of goods by Cash on delivery shipping. If all the above conditions are met, the seller undertakes to return the purchase price paid to the buyer by transfer to the account, within 14 working days of receipt of the goods.

 

 All our products are subject to availability. In the event that we are unable to deliver the goods that the buyer has ordered or would like to exchange, we will inform them by e-mail as soon as possible.

 

 

Final Provisions

 

 All changes to these general terms and conditions will be made exclusively in writing and will be published on the seller's website (kaboceramics.com) no later than the day of their entry into force. These general business conditions are valid from October 1, 2020.

 

 

Complaints Procedure

 

The right to raise a complaint

 

 If the purchased goods are damaged, the buyer has the right to complain about the goods. For a correct assessment, it is necessary that the claimed goods are clean, complete. When using the goods, the buyer is obliged to observe, in addition to the generally known rules, also the conditions set for the use and care of the goods in accordance with their natural life. Complaints cannot be made for damages caused by a third party - for example, the seller is not responsible for the breakage of products by the carrier.

 

Place and method of claim

 

 Complaints can be made in writing, by e-mail (kaboceramics@gmail.com) or by post to the address of the atelier kaboceramics, Bořivojova 114, Prague 3. The claimed goods can be delivered in person by prior arrangement or through the carrier. Please send the claimed goods to us properly packed against damage during transport. The complaint must include a written description of the damage that is the subject of the complaint and proof of purchase of goods or postal delivery. The costs associated with sending the claimed goods to us are borne by the buyer.

 

 After receiving the complaint, the buyer will be issued a complaint stating the date when the complaint was received, what goods are claimed, when and where the goods were purchased, what defects occurred and the price at which the goods were purchased. The complaint form is sent to the buyer's address by e-mail. If the buyer complains about the lack of goods, the seller will duly investigate the issue. The maximum time for handling a complaint is set by law at 30 days, but since each piece is original, please understand if there is a delay during the complaint, of which we will of course inform you immediately. If it is not possible to repair or exchange the goods, we will send you the amount for the goods back to your account within 14 days.

The seller is not responsible for defects

 

 If the buyer caused the damage himself or if the buyer knew about the lack of goods before taking over the goods and for which a discount was granted on the price of the goods. Seller will also not be responsible for defects caused during the warranty period due to wear and tear of the goods, improper or excessive use, mechanical damage or destroyed by improper handling.

 

Deadlines for making a complaint

 

 The seller is responsible for the defects of the goods for a period of 24 months from the receipt of the goods by the buyer, if the goods, its packaging or the warranty card does not state a longer warranty period.

If the complaint is settled by repair, the warranty period is extended by the time from the claim to the day on which the consumer is obliged to take over the goods after the repair, even if he/she has not done so. If the complaint is settled by exchanging the goods for new goods, the new warranty period runs from the day when the goods were handed over, resp. sent to the buyer. If the claim for defective goods are not made during the warranty period, the right of liability for defects expires. The buyer will be informed in person, by telephone or by e-mail after the complaint has been settled.

 

 

Privacy Policy

 

 We value our clients and we try to adapt our communication with you to this fact. We are aware that e-commerce requires a great deal of trust, and we want to respect your privacy. We will not share any information you submit with any third party and we undertake that this website (kaboceramics.com) is their sole owner. An exception is external carriers to which customers' personal data are transferred to the minimum extent necessary for the delivery of goods. In addition, if we have difficulty processing your order, we will use this information to contact you.

 

 By purchasing on this website, you acknowledge and agree that in order to process the order, ensure removal from storage, delivery of goods and possible resolution of rights from defective performance (complaints), kaboceramics.com will process and store your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, the General Data Protection Regulation (GDPR), to the following extent: name, surname, address, e-mail and telephone number.

 

The legal basis for the processing of personal data is in line with Article 6 (1) (a). b) GDPR.

 

 If you do not ask us to do so, we may contact you by email in the future to inform you of special offers, new products, ceramic courses, workshops and changes to this Privacy Policy. Our privacy policy may change from time to time and all updates will be posted on this page.

 

Custom production

(or Goods made directly to measure according to the Buyer's requirements.)

 Kaboceramics offers the production of ceramic products according to the specific requirements of the buyer. This method of Custom Production has a specific regime, especially with regards to payment (in which case an advance payment is required), delivery date (this is agreed individually and is confirmed by e-mail), withdrawal from the contract.

With regard to withdrawal from the contract for Custom Manufacturing, in accordance with the provisions of § 1837 of the Civil Code, the Buyer may not withdraw from the contract, the subject of which is the delivery and modification of Goods made according to the Buyer's wishes or for his/her person interest.

 

Others

 

 The seller can change the products and services described on its website at any time. We have the right to update or supplement these conditions if necessary
